These Terms & Conditions (“Terms”) governs the use of our website. The Terms “MIKI”, “We”, “Us”, “Our” refer to Miki Travel (Hong Kong) Limited.

These terms constitute a legal agreement. By using our website, you agree to comply with all of these terms and conditions, as amended periodically. MIKI may terminate your account at any time, with or without notice, for conduct that is in breach of these terms, for conduct that we believe is harmful to our business, or for conduct where the use of the service is harmful to any other party.

We may, in our sole discretion, change or modify these terms and conditions at any time, with or without notice. You are responsible to read this document from time to time to ensure that your use of the Service remains in compliance with these terms.

These terms and conditions and any additional terms posted on this website together constitute the basis of the relationship between MIKI and You (“Customer”, “Company”) with respect to your use of this site.

  1. Engagement of Service

MIKI shall provide the Services, Accommodation, Entrance Fee, Interpreter, Restaurant (Meal), Transportation, Tour Guide, Technical Visit and other kind of various local services etc., to the Company in accordance with the individual land and river cruise arrangement under the terms and conditions set forth in here. We reserve the right to modify, change, or discontinue any aspect of the Services at any time. Access to the Site is terminated upon expiry or termination of the Service.

  1. Miki Travel Asia Services

2.1
The Miki Travel Asia Services provide you with an easy and simple way to select and purchase tour itineraries, transportation services, tickets and other travel experience related services supplied by Miki Travel Asia or our third party suppliers (“Suppliers”) through the Miki Travel Asia Platform. To the fullest extent permitted by law, you also agree that we may change, suspend, discontinue or terminate any services at any time and may impose regulations or restrictions on, or amend the terms of certain services, or limit your access to any part or all of the services, without prior notice to you.

2.2
You may incur fees and expenses which shall be paid to the Suppliers by you through your use of the Miki Travel Asia Services. In addition, you may be subject to the terms and conditions imposed by the Suppliers. You acknowledge and agree that you are solely responsible for all such fees and expenses, and you agree to pay all such fees and expense and abide by all such terms and conditions imposed by the Suppliers.

2.3
We will make effort to maintain the operation of the Miki Travel Asia Services and the Miki Travel Asia Platform, but we do not warrant that the Miki Travel Asia Services and the Miki Travel Asia Platform will always function properly or stay uninterrupted by external factors. You agree that we reserve the right to reject your visit to the Miki Travel Asia Platform or your use of the Miki Travel Asia Services, and you also agree that we reserve the right to change, suspend, discontinue or terminate the Mikitravel Services or the Miki Travel Asia Platform.

  1. Fair Period:

Fair Period including Festive Season: Christmas / New Year / Chinese New Year / Easter / Sports Event

If client’s travel period falls in Fair Period, surcharge may apply on hotel accommodation, coaches, meals, guides or other services due to limited supply. MIKI reserves the rights to relocate clients to stay at a hotel located outskirts of the affected city.

  1. Registration to our website

Requirement for registration

To use some services on our website, you would need to register and accept terms applicable to such registration.

Log-In details

You are responsible to keep any username and password log-in details relating to such registration confidential, safe and secure.

Termination

We may terminate the service under the following circumstances (non-exclusive list):

Where you are in breach of any terms or conditions

When we find that the services are utilized in unregulated manner.

Temporarily suspension of account or particular service if large number of cost effecting services are exploited like SMS, Whatsapp etc

Any kind of spamming on the platform

Your use of the Service disrupts our business operations or affects any other party

You may request account termination upon ten (10) days’ notice by contacting us through email.

For this circumstance, each Party must complete its obligations prior the termination.

  1. Copyright

The copyright in the contents of this website belong to MIKI. Copying the contents of this website without permission of MIKI is prohibited except to the extent that such copying is necessary for the purposes of availing of the Services herein.

  1. Security

Security is a major concern to all of us and the situation globally is constantly changing. Events around the world, coupled with the “Travel Advisories” put out by various governments, may at times necessitate changes to the accommodations and itinerary or even trip cancellation. You must accept these risks involved in travel to any country that may experience security difficulties and accept the responsibility for your own travel decisions.

  1. COVID-19

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the World Health Organization, senior citizens and guests with underlying medical conditions are especially vulnerable.

We ask that you please take personal responsibility for your wellbeing. This begins with packing any personal protective equipment and sanitizers’ you require. Please adopt physical distancing and hygiene practices throughout your pre-trip travel arrangements and follow all health instructions whether physical signage, or requests from our professional staff, once you are holidaying with us. To travel with Miki, you voluntarily assume all risks related to exposure to COVID-19.

  1. Force Majeure

MIKI shall not be liable for any loss or damage resulting from delay or failure to perform this Agreement either in whole or in part where such delay or failure shall be due to causes beyond its reasonable control, or which is not occasioned by its fault or negligence, including but not limited to, acts of terrorism, political unrest, war, the threat of imminent war, riots or other acts of civil disobedience, insurrection, acts of God (such as fires, explosions, storms, floods, lightening, earthquakes and other natural calamities), restraints imposed by governments (such as delays to, scheduled transportation and closure of airports or ports) or any other supranational legal authority or any other industrial or trade disputes, pandemic, epidemic and health risk.

  1. Limitation of Liability

MIKI shall under no circumstances be liable for any loss (whether direct or indirect) whatsoever suffered, sustained or incurred by the Company or by other person arising (directly or indirectly) from or out of or relating to the provision of the Service (including but not limit to indemnify, penalties, claims, damages, costs and expenses. With the use of the service provided, Company or any party shall irrevocably and unconditionally accept and agrees to be bound by this term.

      1. Order Confirmation and Refund Policy

10.1
You can select and purchase tour itineraries, transportation services, tickets and other travel experience related services provided by Miki Travel Asia or the Supplier in a specified currency through the Miki Travel Asia Platform. Except for certain orders which will be confirmed immediately after you place your order, other orders must be confirmed by Miki Travel Asia or the Supplier afterwards. You agree to receive notification of successful bookings/orders via SMS, email or mobile applications, and you acknowledge and agree that the time it takes to reply the result of your bookings/orders as indicated on the Miki Travel Asia Platform is for reference only. You also agree that the time it takes to confirm the success of your bookings/orders may be adjusted based on the actual situation.

10.2
Miki Travel Asia reserves the right to change or adjust the prices and fees of tour itineraries, transportation services, tickets, and other travel experience related services provided by Miki Travel Asia or the Supplier at any time. These changes may be announced via SMS, email, the website, and mobile applications. If you use the Miki Travel Asia Services after the notice of such changes, it means you agree and accept the changed prices and fees.

10.3
You agree that Miki Travel Asia may, at our sole discretion, refuse or cancel any booking or order that may violate these Terms of Use.

10.4
You agree that you will pay your bookings/orders in accordance with the payment methods we accept; you acknowledge and agree that we are not obligated to process or execute your bookings/orders until you complete the payment in accordance with the payment process instructed by us. Unless otherwise provided in these Terms of Use, the payment for orders/bookings made by you is non-refundable.

10.5
In the case that the service you selected and purchased is provided by a Supplier instead of Miki Travel Asia, such Supplier will accept or reject your booking/order on its own and be responsible for providing all related services. If you have any questions about the content of the service provided by the Supplier, you may first ask the Supplier to obtain the most direct information; alternatively, you can also contact Miki Travel Asia, and we will try to contact the Supplier to find a solution.

10.6
You acknowledge and agree that the specific service provided by any Supplier may result in additional taxes or fees and expenses depending on the actual situation, and you may also be obligated to pay the relevant amount directly to the Supplier or the tax authority. Although we have requested the Supplier to provide the latest and accurate conditions of use, restrictions, prices and other information with respect to the services they provided, Miki Travel Asia cannot warrant that all content displayed on the Miki Travel Asia Platform will be accurate at all times. If your order/booking is cancelled by the Supplier, Miki Travel Asia will notify you as soon as possible in a reasonable manner. (this last sentence doesn’t relate to the rest of 10.6)

10.7
If you contact us or the Supplier to cancel your order/booking within the cancellation period indicated on the Miki Travel Asia Platform at the time of your order/booking, after you have successfully cancelled and received our notice, or if the service you selected and purchased is cancelled according to the conditions and restrictions set by Miki Travel Asia or the Supplier, the payment you made will be refunded to you in the same way as you paid. You fully acknowledge and agree that the amount refunded may differ from the amount you originally pay due to the foreign exchange rate, or the administration fees or service fees collected by the credit card company or the payment processor.

10.8
Use of E-Voucher

10.8.1
If you select and purchase tour itineraries, transportation services, tickets, and other travel experience related services through the Miki Travel Asia Platform, after the order/booking is successful, except for providing physical vouchers or under other circumstances, you will receive an SMS, email, or mobile application notification confirming your order/booking, which will include the number of your order/booking and an electronic voucher (“E-Voucher”) in accordance with the service you have purchased. In order to use your E-Voucher, you must print out your E-Voucher or present the E-Voucher on your mobile application.

10.8.2
You acknowledge and agree that you must comply with the additional conditions and restrictions of E-Vouchers set by Miki Travel Asia and the Supplier, including but not limited to: you must show up in person and on time at the meeting point designated by Miki Travel Asia or the Supplier within the period of use specified on the E-Voucher, and present documents or materials requested by Miki Travel Asia or the Supplier (e.g., an identification document with your photo, the number of your order/booking, your E-Voucher). If you are unable to meet the conditions and restrictions set by Miki Travel Asia or the Supplier, you may not be able to redeem the content of the service recognized by the E-Voucher, and no refund will be granted.

10.8.3
You acknowledge and agree that if your E-Voucher or the number of your order/booking is lost or stolen, Miki Travel Asia or the Supplier has no obligation to reissue the E-Voucher or provide you with the content of the service recognized by the E-Voucher. In addition, if you attempt to redeem an E-Voucher illegally, for example, if you do not meet the legal age for the use of an E-Voucher recognizing a certain content of service, Miki Travel Asia or the Supplier may refuse to accept your redemption of the E-Voucher, and no refund will be granted.
